Judging the Judge
If you’ve read Paineful Truth for any amount of time, you’ll have realized that we value history. A lot. Browsing through older articles, you’ll find references to our founding fathers and the Constitution in pretty much every single one.
Why is that?
Because remembering history is vital to the survival of America. It is vital to the survival of freedom itself.
This week, Chief Judge of the Seventh Circuit Court of Appeals, Richard A. Posner said this:
“...I see absolutely no value to a judge of spending decades, years, months, weeks, days, hours, minutes, or seconds studying the Constitution, the history of its enactment, its amendments, and its implementation...Eighteenth-century guys, however smart, could not foresee the culture, technology, etc., of the 21st century. Which means that the original Constitution, the Bill of Rights, and the post–Civil War amendments (including the 14th), do not speak to today.”
This utter and complete nonsense is due to a rejection of our history. Justice Posner has apparently forgotten not only the importance of American history in general, but also the importance of his own history. When he assumed office, he took this oath:

Sadly, this attitude of disregard and animosity to history is rampant throughout society today. Our public schools teach it, our colleges pound it into the heads of students, our public officials distort and disparage our history.
The only way to fight lies is with truth. “History doesn’t matter” is a lie. Here at Paineful Truth, our express purpose is to bring the Truth to the light - history does matter.
Red, White, and Blue History
This being Independence Day weekend, I thought it would be appropriate for a large dose of all-American, red, white and blue, history.
The Declaration of Independence is the charter for the longest ongoing Constitutional Republic in the history of the world. July 4th marks the day we celebrate 240 years of American independence.

What made the difference? Countless other countries have had constitutions and have failed miserably. What has made America last so long in such unprecedented peace, security, success and freedom?
There are 5 principles found in the heart of the Declaration of Independence that provide the answers to these questions. 5 principles that every American should know by heart, and defend with passion.
The Heart of Our Declaration of Independence

1. There exists self-evident truth.

In other words, there is a right and a wrong. This is the only solid foundation of any government. Truth that is universal and unarguable, such as the fact that all men are created equal is not up for debate or legislation. Freedom itself rests on the corner stone of truth.

2. We have rights given to us by God, that no one may take from us.

These rights include, but are not limited to life, liberty and the pursuit of happiness. These rights are also not up for debate or legislation.

3. The purpose of government is to protect our rights.

The reason our elected officials take the oath of office, pledging to support and defend the Constitution, is because our Constitution limits the government to one purpose: to defend the rights of the citizens. That is the reason we have government in the first place.
The purpose of government is not to provide for us, but to protect our rights so that we are free to provide for ourselves and those in need.

4. The people grant power to the government, not the other way around.

We tell the government what to do. The government protects our rights. We elect representatives to do our bidding. When they don’t, we remove them and elect different leaders.

5. If government is not fulfilling its purpose (protecting our rights) we have a right and a duty to alter it so that it starts fulfilling its purpose.

These 5 principles have always existed. They are part of the “self-evident truth” that Jefferson spoke of. America was just the first to encapsulate them and put them into practice. And it has worked for the last 240 years.
We’ve had our ups and downs, however, because of the solid foundation of truth our founding fathers established, we’ve weathered every storm.

Now we are engaged in an internal struggle that is testing whether we will survive the next storm. Do we unmoor from our past, the truth, our founding principles? Do we choose to float aimlessly on relativistic lies, with no direction, no security?
Or instead, will we realize the vital necessity of our history? Will we realize that the questions have already been answered? That the key is freedom, liberty and independence?
Only you can answer these questions. Every American must cling to self-evident truth, defend the principles that have worked, and passionately live out what it means to be an American.
Today, I declare that I will stand for truth. I will remember our history. I will fight for the principles that have granted freedom.
